2.1. Legal bases for the processing of personal data

Insofar as we obtain your consent for the processing of personal data, Art. 6 (1) sentence 1 lit. a GDPR is the legal basis for the processing of personal data. Any consent can be revoked by you with effect for the future.

When processing personal data that is necessary for the fulfillment of a contract with you or your company, Art. 6 (1) sentence 1 lit. b GDPR is the corresponding legal basis. This also applies to processing operations that become relevant even before the contract is concluded.

Insofar as the processing of your personal data is necessary to fulfill one of our legal obligations, Art. 6 (1) sentence 1 lit. c GDPR serves as the legal basis.
If processing is necessary for the purposes of a legitimate interest pursued by our company or a third party, and your interests, fundamental rights and freedoms do not override our legitimate interest, then Art. 6 (1) sentence 1 lit. f GDPR serves as the legal basis for processing.

2.2. Storage and deletion of data

Personal data is generally stored by us only as long as the specific purpose of storage requires. If the purpose of storage ceases to apply, your data will be deleted or its processing restricted.

In addition, European regulations, applicable national laws, or other provisions may require longer storage of the data we process. If these storage periods expire, we will delete your data or restrict its processing.

2.3.2. Web Hosting

Our Putzmeister Website and thus also your data are hosted by us, among others, with Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, D18 P521, Ireland (“Microsoft”). Microsoft may only access the data within the scope of our instructions (data processing agreement).

Microsoft also takes strict technical measures to protect your personal data. Microsoft does not pass on your personal data to third parties, unless the transfer is necessary for the processing of the agreed services or Microsoft has to do so to comply with the law or a valid and binding instruction from a government or regulatory authority. The data transmitted for this purpose is limited to the necessary minimum.

Microsoft has also announced its intention to introduce the so-called “European Union Data Boundary,” in which Microsoft commits not to transfer data from the EU to third countries. Your data is already hosted on servers in the European Union (“EU”) or the European Economic Area (“EEA”) at this time.

Despite these measures, it cannot be ruled out with absolute certainty that Microsoft may also store or transmit information in countries outside the EEA under certain circumstances. However, Microsoft will take the necessary steps to ensure an adequate level of data protection is maintained. For example, if Microsoft transfers your data to the United States, additional measures, such as concluding EU-compliant data transfer agreements with the data importer, will be taken as necessary. 2.3.3. Transfer of your data to Putzmeister Group companies

Your data will be partially passed on to other Putzmeister Companies for the purpose of processing your contact and providing the services offered via the Putzmeister Website.

The legal bases for these data processing operations are Art. 6 (1) sentence 1 lit. b and lit. f GDPR or a data processing agreement. Insofar as there is no contract fulfillment with you and no data processing agreement, we have a legitimate interest in transmitting the data to the respective competent Putzmeister Company and the responsible departments there for internal administrative purposes. This procedure enables the Putzmeister Group to offer you the services offered via the Putzmeister Website as efficiently as possible.

3. Your Rights

Insofar as we process your personal data, you are a “data subject” within the meaning of the GDPR. As a data subject, you have the following rights vis-à-vis us:

3.1. Right to information regarding processing

You can request information from us at any time, within the framework of legal provisions, as to whether personal data concerning you is being processed by us. If this is the case, you have the right to request information about the scope of data processing (cf. Art. 15 GDPR). 3.2. Right to rectification

You have a right to rectification and/or completion of your data vis-à-vis us, insofar as the processed personal data concerning you is inaccurate or incomplete (cf. Art. 16 GDPR).

3.3. Right to restriction of processing

If the conditions for this are met, you can request the restriction of the processing of your personal data (cf. Art. 18 GDPR).

3.4. Right to erasure

You can request from us that the personal data concerning you be deleted without undue delay, provided that the conditions for this are met. The right to erasure does not exist, for example, insofar as processing is necessary (cf. Art. 17 GDPR).

3.5. Right to notification

If you have asserted the right to rectification, erasure or restriction of processing against us, we are obliged to communicate this rectification or erasure of data or restriction of processing to all recipients to whom the personal data concerning you has been disclosed, unless this proves impossible or involves disproportionate effort. The controller shall inform you about these recipients if you request it (cf. Art. 19 GDPR).

3.6. Right to data portability

You have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format. You also have the right to transmit this data to another company without hindrance from us, provided that the conditions for this are met (cf. Art. 20 GDPR).

3.7. Right to object

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Art. 6 (1) sentence 1 lit. f GDPR (Art. 21 (1) GDPR). The consequence of the objection is that Putzmeister or the Putzmeister Company responsible for data processing will no longer process the personal data concerning you, unless Putzmeister or the Putzmeister Company responsible for data processing can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims.

We ask you to address your objection to the Putzmeister Company responsible for data processing. We will inform you separately at the relevant point in this privacy policy if data processing is carried out not by Putzmeister Holding GmbH, but by another Putzmeister Company. 3.8. Right to withdraw data protection consent declaration

If you have given a data protection consent declaration, you can withdraw it at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

3.9. Right to lodge a complaint with a data protection supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU Member State of your habitual residence, place of work or place of the alleged infringement, if you consider that the processing of personal data relating to you infringes applicable data protection laws.

4. Security Standards

We have implemented appropriate physical, technical and administrative security standards to protect personal data from loss, misuse, alteration or destruction. All service providers and affiliated companies are contractually obliged to maintain the confidentiality of personal data. In addition, they may not use the data for purposes that have not been approved by us.

Since the security of your data is important, your entire visit is handled via a secure TLS connection. If personal data is collected, the data transfer also takes place via TLS encryption. The TLS encryption procedure protects your data from unauthorized access on its way through the internet.

5. Amendment of the Privacy Policy

B. DATA PROCESSING ON THE PUTZMEISTER WEBSITE

1. Log Data / Log Files

Each time you access the Putzmeister Website, our system automatically collects data and information from your end device. In particular, the following of your data is collected:

  • the IP address of the requesting end device
  • the date and time of access
  • the website from which access to the requested file takes place (referrer URL)
  • a description of the browser and the version of the browser used
  • if applicable, the installed operating system and the set resolution
  • the name of the file and the URL of the requested file
  • a description of the access provider used by you
  • your dwell time
  • the amount of data transferred
  • the access status (i.e., whether the file was transferred or possibly not found, etc.)

The aforementioned data is stored in the log files of our system. As a rule, this data is not stored together with other personal data. Insofar as access statistics are created, your IP address is anonymized by the hoster by truncating the last bytes of the IP address. Your IP address can therefore no longer be assigned to you in the access statistics.

The legal basis for the temporary storage of data and log files is Art. 6 (1) sentence 1 lit. f GDPR. We have a legitimate interest in collecting and temporarily storing the aforementioned data, as the temporary storage of the IP address by the system is necessary to enable the delivery of the website to your end device. The temporary storage of data also takes place to enable the delivery of the website. In addition, this data serves to optimize our website and to ensure the functionality of the website and the security of our information technology systems. The log files are not evaluated for marketing purposes.
In the case of data storage in log files, the data is usually deleted after 30 days. Data is stored for reasons of system security, for example, to clarify cases of misuse, security incidents, or malfunctions. If the storage or access is absolutely necessary for us to provide a service expressly requested by you, Section 25 (2) No. 2 TDDDG is the relevant legal basis.

Plugins from www.youtube.com are integrated on our website. We use embedded YouTube videos in enhanced privacy mode. YouTube describes its operation as follows: “With enhanced privacy mode, you can embed YouTube videos without cookies being set to analyze user behavior. This means no data on user activities is collected to personalize video playback. Instead, video recommendations are based on the current video. If you access pages of our website that are equipped with a YouTube plugin, a connection to the YouTube servers is established and the plugin is displayed on the website by notification to your browser. The primary legal basis for this is Art. 6 (1) sentence 1 lit. b GDPR or Section 26 (1) BDSG or comparable national regulations. Personal data will only be processed for purposes related to your interest in a current or future employment with the respective Putzmeister company and the processing of your application.

For the receipt, coordination, administration, and forwarding of applications within the Putzmeister Group, the centralized HR department at Putzmeister Holding is responsible. If Putzmeister Holding does not fill the vacant position, your application will be forwarded to the company where the respective vacancy is open or to which your unsolicited application is to be assigned. If Putzmeister Holding is not itself responsible for the further processing of the application as a potentially hiring company, Putzmeister Holding acts on the basis of an agreement on joint responsibility. Putzmeister Holding is also available to you as a central contact person for data protection issues in connection with the application process, to whom you can assert your data protection rights and who coordinates the processing of your data subject rights. C. DATA PROCESSING OPERATIONS WHEN USING MY PM SERVICES

1. Controller

Putzmeister Holding GmbH is the controller for the “MY Putzmeister” platform within the meaning of the GDPR. Digital services for products of the Putzmeister Group (“MY PM Services”) are accessible via MY Putzmeister. 2.1. Registration process for MY Putzmeister

Employees of companies can register for MY Putzmeister. During registration for MY Putzmeister, there are certain mandatory details you must provide, as well as voluntary details that are separately marked.

We use, store, and process this data because it is necessary for the establishment, content design, or modification of the user relationship between you and us, as well as for the use of the MY PM Services offered via MY Putzmeister.

If you have successfully registered, you can log into your user account after activation. We use, store, and process your data used for registration, such as your email address and the password you set, so that you can log into MY Putzmeister and access the MY PM Services available there.

2.2. Activation Process

To verify whether you, as an employee, are authorized to use MY Putzmeister on behalf of the company, Putzmeister may transmit the information you entered during registration to the company or your employer’s dealer before activating your profile. The transmission of your data entered during the registration process to the company or dealer in this case is to verify whether you belong to the company and are authorized to use MY Putzmeister and the MY PM Services.

3. MY PM Service: Product and Color Configurator

Controller within the meaning of the GDPR: The Product and Color Configurator is an offer from Putzmeister.

You have the option to request the implementation of the configuration you have made from us. If you are logged into MY Putzmeister, you can send the configuration without providing further data. The configuration you send will be automatically assigned to the data stored in your user account with MY Putzmeister.
If you do not have a user account with MY Putzmeister, you can also request the configuration you have made. For this, you can either fill out an inquiry form or send the code assigned to the respective configuration to a dealer or sales contact of the Putzmeister Group (e.g., via email).

If you inquire about the configuration from us via the inquiry form or email, the data entered in the fields or provided via email will be transmitted to us and stored. This includes, in particular, your first and last name, your email address, and all other data entered in the fields or disclosed by you in the email.

The processing of personal data serves solely to process your configuration inquiry and to contact you. This is in our legitimate interest. This may already involve the initiation of a contract.

We transmit your personal data entered during the configuration inquiry to the Putzmeister company that is internally responsible for the realization of corresponding configurations. Data processing for the purpose of processing the configuration inquiry is in any case terminated when it can be inferred from the circumstances that the matter has been conclusively clarified.

4. MY PM Service: Warranty Tool

Controller within the meaning of the GDPR: The Warranty Tool is an offer from Putzmeister.
Putzmeister offers you the opportunity via the Warranty Tool to process warranty cases digitally on behalf of the company for products that are subject to warranty or special complaint provisions, or for which the Putzmeister companies have assumed a guarantee (“Warranty Application”).

As part of the Warranty Application, various data about the product, the defect, and any repairs already carried out on the defect are requested. If you decide to report a warranty case via the Warranty Tool, the data entered in the fields will be transmitted to Putzmeister and stored. This includes, in particular, your email address stored for registration with MY Putzmeister and all other data entered in the fields.

After you have submitted the completed Warranty Application, Putzmeister will forward it with all the data you provided to the Putzmeister company that placed the respective defective product on the market and is responsible for processing the warranty case within the Putzmeister Group. The data will be transmitted exclusively for the purpose of processing the warranty case reported by you.

The legal bases for the aforementioned data processing are Art. 6 (1) sentence 1 lit. b and f GDPR. We delete your data as soon as it is no longer required for the stated purpose and no contractual or legal retention periods exist.

5. MY PM Service: MY Fleet

Controller within the meaning of the GDPR: MY Fleet is an offer from Putzmeister.
Putzmeister offers you the opportunity via MY Fleet to centrally manage the company’s entire machine fleet on behalf of the company, retrieve individual information about the machines, and gain an overview of upcoming maintenance work (“Upcoming Services”) on the machines in the fleet.

In MY Fleet, you have the option to store your contact details as a contact person for the company, including your name, email address, and phone number. Furthermore, as an employee of the machine’s end customer, you have the option to store yourself as a contact person for services to be provided on the machines in the fleet. In addition, within the input fields for contact details, you can select whether you wish to receive notifications about Upcoming Services at the email address you have stored. In these email notifications, we will inform you if a service status of a machine has changed (e.g., information about upcoming or overdue maintenance work on the machine). You have the option to remove your stored contact data at any time. Companies can also create checklists for their fleet.

Putzmeister processes the data you provide exclusively to provide the services within MY Fleet and to send the aforementioned email notifications regarding the service status. The data stored by end customers is visible to the dealer stored with the machine, provided that the dealer also has access to MY Fleet. This ensures that the dealer has access to current contact details of the end customer and can assist them with problems related to services on the machine. This does not apply to checklists; these cannot be edited by dealers.

Insofar as dealers are authorized to access MY Fleet, the dealer’s employees can store their contact details as contact persons for end customers. The data stored by the dealer’s employees is visible to the end customer stored with the machine.

6. MY PM Service: Quick Service List

Controller within the meaning of the GDPR: The Quick Service List is an offer from Putzmeister.

Putzmeister offers you the opportunity via the Quick Service List to non-bindingly reserve the machines shown in the Quick Service List by making an inquiry with the Putzmeister Group sales department on behalf of the company.

The data you provide in the reservation inquiry (e.g., name, company, contact details, etc.) will be transmitted to Putzmeister and stored by them. Putzmeister will forward your reservation inquiry and the data contained therein to the responsible department within the Putzmeister Group so that your reservation inquiry can be processed by the respective responsible department.

The MY PM Service Machine Cockpit and thus also your data are hosted by Amazon Web Services EMEA SARL, 38 Avenue John F. Kennedy, L-1855 Luxembourg (“Amazon EMEA”) and Amazon Web Services Inc., 410 Terry Avenue North, Seattle WA 98109, United States (hereinafter “Amazon USA”; both jointly: “Amazon”).

Amazon EMEA processes and stores your data as a user of the MY PM Service Machine Cockpit, regardless of the region in which you register. The machine data generated during the use of the MY PM Service Machine Cockpit, which is not personal data, is processed and stored by Amazon USA for Putzmeister machines sold in the United States of America. Machine data of all other machines is processed and stored by Amazon EMEA.

Amazon may only access the data within the scope of our instructions (data processing agreement). Amazon also takes strict technical measures to protect your personal data. Amazon does not pass on your personal data to third parties, unless the transfer is necessary for the processing of the agreed services or Amazon is obliged to do so to comply with the law or a valid and binding instruction from a government or regulatory authority. The data transmitted for this purpose is limited to the necessary minimum.

Amazon may also store the information in countries outside the European Economic Area. However, Amazon will take the necessary steps to ensure that an adequate level of data protection is maintained. 8.1. Purchase and Inquiry of Products via the Web Shop

On the Putzmeister website, you have the option to order products via your MY Putzmeister account. Guest orders are not possible. If you do not have a MY Putzmeister account, you can only inquire about products.

If you order via your MY Putzmeister account, a large part of the data stored in your account will be automatically adopted for the execution of the order. No re-entry is required. Your personal data necessary for the execution of the order will be transmitted to the Putzmeister company that sells the product and thus fulfills the order.

8.2. Payment by Credit Card

If you choose to pay by credit card, payment processing is handled by the payment service provider Adyen N.V. German Branch, Friedrichstraße 63, 10117 Berlin (“Adyen”).

If you pay by credit card, Adyen collects the following data:

  • Name of the credit card holder
  • Credit card number
  • Credit card validity period
  • Security code

Putzmeister does not collect and store payment data itself. This is collected directly by Adyen. Adyen only has knowledge of the order number and the invoice amount, in addition to the payment data provided, without being able to assign this information to other information.

Putzmeister adheres to the highest security and data protection standards when working with Adyen. Adyen complies with the requirements of the “Payment Card Industry (PCI) Data Security Standards” and has been certified according to Level 1 of the PCI Standard (further information on this can be found here: https://www.adyen.com/de_DE/plattform/zertifizierungen). Adyen is also audited by the Payment Card Industry Security Standards Council for compliance with the PCI Standard.

1. Data Processing by Social Media Platforms in General

We operate publicly accessible company profiles on social media platforms to inform about our news, events, and to provide insights into the Putzmeister company and other companies belonging to the Putzmeister Group. Furthermore, it enables contact with you as a user/visitor of the social media platforms. You can find out on which platforms we operate a company profile further down in section 6.

Social media platforms such as Facebook, Twitter, etc. can typically analyze your user behavior comprehensively if you visit their website or a website with integrated social media content (e.g., Like buttons or advertising banners). Visiting our social media profiles triggers numerous data protection-relevant processing operations. The respective social media platforms may provide us with anonymized statistics and insights, including information about interactions with our posts. From this information, we can determine whether our website was accessed by users/visitors from the respective platform via our company profile, as well as age/gender groups (the latter only for logged-in users). We have no control over the data transmitted to us and cannot prevent this procedure by the social media platforms. We use the data transmitted to us to optimize our posts and our presence and to design them according to the interests of our website visitors.

The social media platforms store cookies on your device or capture your IP address. This serves to evaluate the data from visits to the social media platform and our company profile for statistical and market research purposes and may help optimize future advertising measures by the social media platforms. The social media platforms may use the collected data on user behavior of users/visitors for displaying personalized advertising, which can be shown on all devices on which you are or have been logged in.

If you are logged in when visiting our company profile on a social media platform, the data from your visit to our company profile can be assigned to your account and linked with the data of that account. 2. Legal Basis

Putzmeister has a legitimate interest in operating the company profile and processing your data in order to design and implement contemporary information and communication opportunities appropriately. The legal basis in this case is Art. 6 para. 1 sentence 1 lit. f GDPR.

If you contact us via the messaging function or via the email address provided in our company profile, we store your user profile identifier or email address as well as other data you provide. The legal basis for processing is Art. 6 para. 1 sentence 1 lit. b GDPR, insofar as the contact relates to contract initiation or contract-related matters. We also have a legitimate interest in processing your data in order to respond to your inquiry, Art. 6 para. 1 sentence 1 lit. f GDPR.
The analysis procedures used by the social media platforms may be based on different legal bases that must be specified by the operators of the social media platforms (e.g., consent within the meaning of Art. 6 para. 1 sentence 1 lit. a GDPR; consent can be revoked there at any time).
